Your privilege will remain suspended or revoked indefinitely until you comply with all reinstatement requirements and receive a new license. There is no time limit or statute of limitations for reinstating suspensions or revocations.

In addition to any other requirements, you may have to take vision, written, and driving skills tests. The driving skills test will be required if your license has been suspended or revoked for more than one year.

DUI Revocations

If your license is revoked based on a DUI or failure to submit to testing, you may reinstate your driving privilege before the end of the revocation period by installing an ignition interlock device on any vehicle you operate.

The action may be joined with an action for divorce, annulment, separate maintenance or support. A person who has sexual intercourse in this state thereby submits to the jurisdiction of the courts of this state as to an action brought under this chapter with respect to a child who may have been conceived by that act of intercourse.

A Commercial Driver License (CDL) authorizes an individual to operate a commercial motor vehicle or combination of motor vehicles used to transport passengers or property. Individuals applying for a Commercial Driver License should recognize that this is a professional license with more testing requirements than other licenses. You must present a Certificate of Compliance in person at a DMV office and follow any other reinstatement procedures as well. Requirements may include written testing, SR-22 insurance and payment of reinstatement fees.

Non-DUI License Withdrawals

If your license is suspended because of a court order related to a case such as Failure to Appear, you must resolve all of the criminal charges before your license can be reinstated.

Chapter 284 of the Nevada Revised Statutes and the Nevada Administrative Code. The 'Disciplinary Procedures, Adjustment of Grievances, and Prohibitions and Offenses' section of NAC 284 provides that each appointing authority will determine and describe in writing standards of conduct appropriate to the mission of the Agency. After DACA, California was the first to act to allow deferred action recipients to be issued driver’s licenses. All states now issue driver's licenses to DACA recipients. Currently, 15 states and the District of Columbia allow unauthorized immigrants to obtain a driver’s license. These states—California, Colorado, Connecticut, Delaware.

The DMV does not notify drivers when the suspension or revocation period has ended. The notice sent to you when the action was first taken clearly states the beginning and ending dates. Drivers with multiple suspensions or revocations must wait for all periods to end before applying for reinstatement.

The Real ID Act

When you reinstate your license, you have a choice between a license that complies with the federal Real ID Act of 2005 or a standard Nevada license.

A Real ID license will be required in the future for federal purposes such as boarding aircraft and is marked with a gold circle and star cut-out. A standard license is marked 'NOT FOR FEDERAL OFFICIAL USE.'

To obtain a compliant license, you must show proof of identity, social security number and residential address one time at the DMV. See the Real ID Act in Nevada for more information and a list of acceptable documents.

Clearance letters

Former residents who now live in another state may pay their reinstatement fee and obtain a clearance letter by using the Payment Authorization Form (ADM 205). Please contact us before faxing or mailing your payment. You may be required to meet additional requirements. A clearance letter does not reinstate your driver license. It will clear your driving status in Nevada to obtain a driver license in another state.

SR-22 Proof of Financial ResponsibilityTop ↑

If you are required to maintain an SR-22 filing as a condition of your reinstatement, it must be maintained for three years from the date you reinstate your driver license.

If at anytime during the three-year period you fail to maintain the SR-22, your driving privilege will be suspended. This may result in starting the three-year requirement again. If we receive a cancellation of your SR-22, you will be notified of a possible suspension by certified mail. Please be sure to have the correct address on your driver's license to ensure that you receive our notice.

There is no statute of limitations on the SR-22 requirement. The continuous three-year requirement begins from the date you reinstate your driver's license regardless of how long you have been in suspension or when you purchased the coverage.

The DMV does not notify drivers of when they are eligible to remove the SR-22 filing. If you are unsure of the date, please contact us.

If you do not maintain coverage continuously during the required period, your insurance company will notify the DMV by sending a Form SR-26. DMV will suspend your license and send notification of this to you by certified mail. The required period of coverage will begin over. Be sure we have your correct address. See Address Changes.

All 51 U.S. driver license jurisdictions share information on suspensions, revocations, cancellations, denials and serious traffic violations through the National Driver Registry/Problem Driver Pointer System or the Commercial Driver License Information System.

A suspension or revocation must be cleared by the state which originated it. There is no time limit or statute of limitations on how long an active suspension or revocation remains listed and in effect.

If your license is suspended or revoked in another state, you must follow that state's reinstatement procedures. See Links to All 50 State DMVs. There is no need to contact the Nevada DMV until you have completed the process. Most states will issue a clearance letter and you will not have to physically travel there. Once your record is cleared in the national database (the Problem Driver Pointer System), you may apply for a Nevada driver's license.

If your license is suspended or revoked in Nevada and you have left the state, contact us for reinstatement requirements. In many cases, we can send you a clearance letter by mail. DUI suspects may have their driving privileges reinstated following an arrest by installing an ignition interlock device on any vehicle they operate.

A court may also order a motorist to install an interlock as part of sentencing.

The DMV will issue a driver's license with Restriction Y after the motorist presents proof of the installation and meets any other reinstatement requirements such as fees, testing and SR-22 insurance.

Interlock manufacturers are certified by the Nevada Committee on Testing for Intoxication. Manufacturers contract with local auto audio retailers, dealers or garages to install and maintain the devices.

Once you have reinstated, you are no longer eligible to request an Administrative Hearing on your license revocation. (NRS 484C.230(1))

The driver must pass a breath alcohol test before the vehicle will start and is subject to retesting while driving. Interlocks include a camera focused on the driver's seat to verify identity.

Penalties for tampering with an interlock or driving a vehicle not equipped with one include jail or house arrest and a minimum driver's license revocation of three years. (NRS 484C.470)

Countdown to Real ID

A Real ID will be required beginning October 1, 2021, if you wish to use your driver’s license or state ID card to board commercial aircraft on domestic flights. Secure federal facilities, such as military bases, already require licenses/IDs to be Real ID compliant.

Wait until your next DMV visit if possible

You can upgrade to Real ID at the same time as any other DMV transaction such as a name change, address change or even a vehicle registration. Make only one appointment for both!

No upcoming DMV visit?

You should upgrade to a Real ID as soon as possible to avoid a rush later this year. You must visit a DMV office.

How do I get it?

Make sure you have the correct documents!

You need to present proof of identity, name change(s), your Social Security number and two residency documents one time only. Review the list below carefully.

These are generally the same documents you used to obtain your Nevada license or ID the first time. You must show them again, plus two documents that show your Nevada residential address.

You must apply in person at DMV office. Make an appointment at our offices in Carson City, Las Vegas or Reno.

Fees

The fee for a Real ID only (Change of Information) is $9.25 for a driver license, $8.25 for an ID card or $13.25 for a commercial license. Other driver license/ID changes of information, such as an address change or name change, may be included with no additional fee.

There is no additional charge for a Real ID if you are completing another license/ID transaction such as a renewal or adding an endorsement.

The Change of Information fee will apply if you are completing a vehicle registration or other transaction and the Real ID is the only change to your license or ID card.

Real ID License Standard License

These examples show cards issued on or after November 12, 2014, when Nevada came into compliance with the Real ID Act.

A Real ID driver's license or ID card has a gold circle with a star cutout in the upper right-hand corner.

Standard licenses or ID cards have a heading stating “NOT FOR FEDERAL OFFICIAL USE.' These cards meet Nevada proof of identity standards.

Licenses and ID cards are marked “LIMITED TERM' when immigration documents are used to prove identity. These expire at the same time as the holder's U.S. Visa.

Cards issued prior to November 12, 2014 remain valid until expiration. However, they do not contain the gold circle or the statements on federal use or limited term. They will not be accepted for federal purposes on or after October 1.

The Real ID License or ID Card

No. You receive only one state-issued driver's license or ID card. This may be compliant with the Real ID Act or it may be a standard license or ID. Nevada also issues Driver Authorization Cards to those who cannot meet the Real ID or standard requirements.

Existing Nevada driver’s licenses and ID cards will be accepted for boarding aircraft until expiration or October 1, 2021, whichever is sooner.

The Real ID Act establishes minimum standards for proof of identity and requires residents to meet these standards one time to obtain a compliant license or ID. In Nevada, proof of identity presented prior to November 12, 2014 meets older standards but is not valid to obtain a Real ID license or ID card.

The Department of Homeland Security did not include military ID on the list of acceptable documents for obtaining a Real ID. See Residency & Proof of Identity.

U.S. military ID will continue to be accepted for boarding aircraft and other federal purposes. However, one advantage to Real ID is that other state DMVs will accept a Real ID as proof of identity for obtaining a driver's license or ID.

Real ID Uses and Enforcement

Drivers Action Act Nevada Requirements

Real ID is a coordinated effort by the states and the federal government to improve the reliability and accuracy of state-issued identification documents, which should inhibit terrorists’ ability to evade detection by using fraudulent identification. Real ID implements a 9/11 Commission recommendation urging the federal government to “set standards for the issuance of sources of identification, such as driver's licenses.”

Passed by Congress in May of 2005, the Real ID Act was part of the Emergency Supplemental Appropriations Act for Defense, the Global War on Terror, and the Tsunami Relief Act. It is not Nevada law but federal law that sets identification standards for state driver's licenses if those licenses are to be used as identification for boarding an aircraft, entering a federal building where identification is required or entering a nuclear power plant.

The Real ID Act is intended to combat terrorism, identity theft, and other crimes by strengthening the integrity and security of state-issued identification. The Act calls on states to implement a set of minimum national standards in several areas:

  • Information and security features that must be incorporated into each card
  • Proof of identity, date of birth, Social Security number, lawful status, and primary residence address
  • Verification of the source documents provided by an applicant
  • Increased security and privacy of personal information collected when applying for a driver’s license or identification card

The Real ID Act establishes minimum standards for the production and issuance of state-issued driver’s licenses and identification cards.

It prohibits federal agencies from accepting state-issued driver’s licenses and identification cards for certain official uses unless the Department of Homeland Security determines that the state meets Real ID standards. Official uses are defined as accessing secure federal facilities, entering nuclear power plants and boarding federally-regulated commercial aircraft.
